A man has been spared a driving ban for being behind the wheel of a van without insurance and with illegal tyres after magistrates heard that losing his licence would lead to his deportation.

Majthub Osman Majthub, 31, of Beckhampton Street, appeared before magistrates sitting in Swindon last week where he was convicted of driving an 02-plate Mercedes Sprinter with a number of defects on Marlborough Road on February 20 without insurance.

The court heard that one tyre had a tread depth of 0.6mm and 1.2mm on another, the hazard warning lights on the vehicle did not function on the front and rear of the vehicle and the nearside loading door to the cargo section of the van was not properly closed and was held partially closed by a piece of string which was linking the loading door to the passenger door handle.

He also faced a further charge of allowing another man to drive a 54-plate Ford Transit Van on January 29 which also did not have a valid insurance policy.

But the magistrates ruled that a driving ban would lead to exceptional hardship for the defendant and his family, as he risked facing deportation if he lost his licence.

They fined him a total of £160 and ordered he pay a £30 victim surcharge along with £85 costs to the Crown Prosecution Service.
