Mum who stole £10k from pre-school escapes jail sentence


A mother-of-five who plundered thousands of pounds from a pre-school group leaving it bankrupt has walked free from court.

Claire Kirkham, 36, used the money as her own as she frittered away almost £10,000 on treats for herself over a two year period.

But after hearing that Kirkham had children aged from six months to 12 years old, a judge took ‘a merciful course’ and imposed a suspended sentence.

Lynne Henderson, prosecuting, told Swindon Crown Court on Friday that Kirkham became chairman of the Kingfisher Pre-School in Westbury in May 2006.

But within months she started to siphon cash from the charity, which runs the playgroup in Arundel Road.

The court was told that in late July 2008 wage cheques for staff bounced and other committee members became concerned about the finances.

Kirkham passed off the incident saying there had been a cashflow problem and would ask for their overdraft to be extended.

But one of the mums was not satisfied and asked to see the books, which had a number of cheques with blank stubs.

When she pointed them out, Kirkham demanded the accounts be returned and the blank stubs were for void cheques.

However inquiries with the bank showed they had been made out for cash and been countersigned by the other committee member.

It was soon discovered that Kirkham had asked two different committee members to countersign paycheques and not tell the other before cashing one of them.

She also transferred more than £3,380 from the charity’s building society account to her own and pinched £300 in cash in September 2006.

In total she took £9,566.22p between July 2006 and July 2008.

The committee called a special meeting where she denied any wrongdoing and resigned from her post.

After the police became involved she again said she was not involved, saying someone must have forged the cheques, causing detectives to call in a handwriting expert.

Kirkham, of Bremeridge Road, Westbury, pleaded guilty to two counts of fraud and one of theft.

Ian Halliday, defending, said “She is at something of a loss to explain her misconduct.”

Her husband was in good employment and they had enough to get by on, but she used what she took on ‘frivolous things’ like treating herself to nice clothes.

“It was a breach of trust, yes, but there was nothing artful or sophisticated in the way the offences were committed,” he said.

He said if she were jailed it would cause massive problems for her family and pointed out she already suffered the punishment of losing her standing in the community.

“On her behalf I ask for clemency,” he said.

Passing sentence Judge Charles Wade said: “In your capacity as the chairperson of this pre-school playgroup you systematically defrauded it and stole from it over a period of two years to an extent of just under £9,500. A significant sum.

“You were in a position of significant trust which you completely abused over that time to the financial detriment of that playgroup.

“As I understand it, it is still going but it was made bankrupt after you had taken the money you did.

“You exploited your position, took advantage of the fact you could draw cheques on the charity’s bank and effectively use the money as your own, which is what you effectively did.

“Then frankly to make matters worse you continued to deny you had done anything wrong.”

He imposed a nine month jail term, suspended for a year and told her to do 150 hours of community service.

Prosecutors are also seeking to recover the money she took at a future hearing.

She should have been sent to prison, it doesn't matter she had kids, I would under stand if she was broke and used if for the kids I.e. Food, clothing but using it for herself is disgusting.... Where is the punishment? so she got 150hrs community services that works out she paid herself £66.66 for the community service

I agree with mac1989, she should have been sent down. If a bloke (with kids) did it, I'm pretty sure he would be sat in prison right now. But she gets out of it because she is a "mother". Perhaps her kids would be better off away from such a bad influence.

agree with you moonrakin.... if it had been money stolen from the government she would be sat in prison now.
what punishment has she actually had?? none as far as i can see... it will teach her kids that you can steal and get away with it... i also agree with elvis..if she had been a man he would have been in rison with no thoughts about the children...
the law is a complete arse at times...
i thought it would have been better to let people see that the law is upheld and dealt with..NOt letting peope who steal £10.000 go free. it doesnt set a good example to others really does it??

Should of been sent down,her kids are better off with their dad,they will have to uproot schools and move eventually no doubt as there are too many angry people out there.Lots of people have job issues and financial struggle but we dont steal from other innocent people to get by.Well anyone can do this same thing and get away with it then.No doubt she will get a new identity too paid for by the taxpayer,i feel for her family but she should of been sent down.I am sure the school with be upset that she got away with it.

There for the grace of good go all of us that are involved in Committee run organisations, trust is always given to Chair and Treasurer, this lady was obviously very clever in covering her track, my question is why did the Charities commission or Accountants not pick up the loss of money, the balances decreasing? Lesson to us all, don't just except what your shown, check it out!

unfortunately due to stupidity of their mother its the kids that will suffer. i hope she feels proud?! sadly her 12 year old is of an age where kids are nasty. the only sympathy i have is for the kids im afraid, she knew what she was doing.

Suspended jail sentence, community service and a further hearing to recover the money hopefully means she will have to pay it all back.

I bet there would have been fewer responses to this if the headline had read: Suspended jail sentence, community service and repayment order for woman who stole from playgroup.

I have never stolen anything in my life, never been quetioned by the police..

even when I was in need of money i never stole or stole money so I could just get the latest pair of jeans/shoes

In order to get back the money I;e Removing goods, takes years and tens of thousands of pounds in court fee's and most of the time they never get the permission.....

Playgroups, Youth Clubs and similar are nearly always run without checks on the accounts because to pay for proper audits can be expensive . I daresay that within Wiltshire other fiddles are being conducted in similar circumstances. When did YOUR club last have an audit ?

Don't get me wrong I'm not defending the woman. I just feel the punishment is adequate - but only if it includes having to pay back every single penny she stole.

If she doesn't pay it back then yes I agree she should go to prison.

Something's broken, badly broken - £10K is three months very well paid work - 150 hours community service is a joke. What did she spend it on? The court needs to explain itself.

Some English courts now will imprison you for asking for an explanation - contempt of court apparently..... WTF is going on ?

I first commented that if she'd have bilked the council out of 1/5th of what she stole she'd be doing porridge - and I stand by that.

The UK legal system *will* break down if sentencing isn't proportionate and consistent and very importantly - transparent.

The judiciary are getting as detatched as the political classes - maybe more so and it'll end in tears.

I don't see your mitigation argument myself - in fact the reverse - the theft of the money was from people who trusted her and the results direct and catastrophic for the kids.

I wonder if the sentence would have been the same if she weren't a nice middle class mummy? - Easy to sneer I know - but perhaps she should spend a while driving a cheaper car, not taking costly holidays, wearing cheaper clothes etc. etc.

If she couldn't afford the payback - I can wear that - but the whole slant of the story is "nice well off mummy has head fit and nicks £10K" tut tut - now go and do some gardening for old folks once a week.
.
Maybe there was mitigation in sentencing - be handy if the court explained the sentence.

It seems a little fishy 2 me !! she seems like a normal law abiding women her husband has a reasonable job they have money but she needs to rob from work ?!?!!? she is either mentally ill or she is addicted 2 something :- drugs, booze or online poker. I have stolen huge amounts of cash to fund all 3 of these through out my life so i would know !!! Id love 2 know what it was

There are several that mention the kids, but none that attack them.

The article mentions her kids because the judge took them into consideration when sentencing, a relevant and reportable fact, don't you think? And it doesn't mention which school they go to either.

Actually Trapezium my post said the kids would probably have to end up being uprooted to another school because the mother has made a lot of enemies through what she did,not the kids, also that i felt for her family.For what reason would i of said the kids were being given a hard time as i dont live there or know the family,pay attention and stop spouting rubbish yet again.

It is her husband and children I feel sorry for, I have known her husband for over 20 years and know he is a decent, law abiding, hardworking bloke who tries to do the right thing. I only hope people don't judge him and the kids by his wife's actions.

I think that's a little harsh, I'm sure the man who shot Franz Ferdinand didn't have any intention of starting a War. And to be fair, it wasn't him who declared it, anyway. Someone simply used his actions as an excuse to start a War they'd all been itching for anyway.

But it's a nice analogy, although I fail to see it's relevance here at all.
