TWO men who were accused carrying out a violent assault in an Old Town pub have had the charges against them dropped.
Arthur Levett, 27, and Paul Flynn, 52, were to stand trial after pleading not guilty to a charge of actual bodily harm But after the alleged victim of the assault lost interest in the case, prosecutors decided to offer no evidence.
Recorder Sam Qureshi entered formal not guilty verdicts.
Colin Meeke, prosecuting, said: “It became clear that the complainant was not going to attend court and give evidence and that other witnesses had expressed a similar view.
"Witness summonses were sought – in fact there had been an error in issue and service of those. Be that as it may, I have decided to offer no evidence.”
The pair were said to have taken part in an assault on Joseph Gardiner at The Globe, in Eastcott Hill, on Sunday, January 6, last year.
The judge also made defendants’ costs orders to cover out-of-pocket expenditure by Flynn, of Churchward Avenue, and Levett, of Park Street.
