A MAN stole his own mother's car from outside her Penhill address while drunk in order to go to the kebab shop, despite holding no licence or insurance.

David Mundy had asked his mother for money for a takeaway and, going into her Chevrolet Spark to find some cash, stole the vehicle and drove to the kebab shop.

His mother immediately called the police, telling them her car had been stolen by the 26-year-old.

A patrol officer spotted Mundy coming back from the shop with his food along Grafton Road, when he failed a roadside breath test and was arrested.

The night out, on June 14, has now cost Mundy £900 in fines, and he has also been banned from driving for the next year.

Pauline Lambert, prosecuting at Swindon Magistrates' Court on Wednesday, said: “This is an offence which involves a relative’s vehicle.

“Police were contacted by the defendant's mother, reporting her son David had just stolen her car, was intoxicated, and and did not have a driving licence.

“A police officer on patrol sees the vehicle in Cricklade Road, driving with no lights on.

“It is followed to Penhill Drive and back to Farndale Close.

“The car was stopped, Mr Mundy was seen to be driving, and a road side breath test was carried out and failed, so he was taken into custody.”

Alex Daymond, defending Mundy, said: “Mr Mundy has not prevaricated in any way.

“He has convictions but this is the first time he has been involved in an incident like this.

“I would say the court could hit him in the pocket rather than anything else.

“He had been out drinking and came back home with no intention of driving. He wanted to get a kebab, and his mother said there was money in the car.

“It appears drunken temptation got the better of him and he decided to drive to the kebab shop.

“He was seen by the police and was stopped when he was returning home. Had there been other road users around at the time there would obviously have been a risk.

“He knows he is going to be disqualified. At the time he was taking lessons at least, so there was some driving experience there.”

Mundy was fined £300 for driving with no insurance, £200 for taking the vehicle, £200 for driving with a provisional licence, and £200 for driving with no insurance.

He was also disqualified from driving for 12 months.
