A TEENAGER who twice raped his girlfriend just a week after she had given birth has been told “when someone withdraws their consent and says ‘no’ then you have to stop”.

The 16-year-old carried on despite the reluctant young mum telling him to stop because of the pain she was enduring.

And after she had gone to the police the lad, who has a history of assaulting the girl who is the same age, tried to get her to drop the charges.

The boy, who cannot be named for legal reasons, carried out the two rapes when his mum was in the house when the girl visited with their child. He denied two counts of rape and one of witness intimidation but was found guilty following a trial at Swindon Crown Court.

A jury heard how the boy repeatedly badgered the girl, also 16, to have sex with him straight after the birth in January. Because she had internal stitches following a complicated delivery she had been told to abstain for at least six weeks but after his repeated pestering and groping she agreed to sex on the condition he use a condom, as she didn’t want to get pregnant again, and stop if it was painful.

But once they started he removed the condom and when she said it hurt too much he did not stop.

He later apologised but two weeks later continued to pester her and she agreed to sexual activity again, unless it was painful.

The lad again continued despite her saying ‘ no’ almost immediately but again he carried on against her will.

At the time of the offending community orders had been imposed on him for head butting her, slapping her and dragging her by the hair in two assaults.

Daren Samat, defending, said the boy had a poor upbringing, seeing domestic violence, and being involved in criminal activity from a young age running drugs for a London gang.

Jailing him Judge Robert Pawson said: “The fact is when someone withdraws their consent and says ‘no’ then you have to stop, I hope you understand that now.”

As well as jailing him he imposed a sexual harm prevention order restricting his liberty for eight years and told him to register as a sex offender for life.

Det Con Alan Mills said: “I welcome this result, in what was a particularly disturbing case. This male was violent, manipulative and controlling throughout the relationship with his then girlfriend.

“I want to thank this young girl for having the bravery to come forward and report the matter to us in what were very difficult circumstances for her.

“I would appeal to anyone who may be experiencing abuse at the hands of their partner to ask for help as soon as possible.
