A Melksham man will be tried for the manslaughter of Trowbridge builder Adrian Cooksey in August.
Richard Elmes, 51, of Semington Road, denies the killing of Mr Cooksey, who was found unconscious in Spa Road, Melksham, by an off-duty police officer in the early hours of March 8, 2009.
Mr Cooksey, 50, later died of his injuries in hospital.
He had three sons and ran building and plumbing firm, A Cooksey and Sons.
Elmes also denies a charge of perverting the course of justice.
At a plea and case management hearing at Bristol Crown Court on Monday, a trial date of August 20 was set, where Elmes will be tried on both counts.
The court heard that the trial is likely to take several weeks.
