A man told the woman who refused him sex “I’m going to rape you”, it was claimed.

After molesting the woman, Alexandru Dediu is said to have told the woman’s daughter as he left: “Call the police, I’ve assaulted your mum.”

The 31-year-old denies rape and sexual assault by penetration.

Opening the case at Swindon Crown Court yesterday, prosecutor Don Tait said Dediu and his alleged victim had been out drinking with friends in Chippenham the night before the assault in the early hours of Monday, June 10, last year.

She had left the pub at around 10.40pm and had words with the Romanian national.

He called her later that evening asking to pick up a coat from her home, Mr Tait told jurors.

She said she would drop it off the next morning on her way to work.

He insisted and she left the door on the latch then went back to bed.

As she dozed she was aware of him coming in through the door and using a downstairs bathroom. He came upstairs and into her bedroom.

The woman claimed he spoke to her, took his clothes off then climbed into bed. He put his arm around her and tried to touch her sexually. She told him to stop and, in response to a request for sex, said she did not want to, jurors heard.

Dediu said “well, I’m going to rape you”, Mr Tait claimed. He grabbed her hair, it was said. She told him: “You haven’t got it in you.” He is then accused of sexually assaulting her in the bed. He told her to scream if she wanted but she remained silent for fear of waking up her children.

Mr Tait said: “If she had screamed this may never have happened.”

After the sexual assault he is said to have slapped her across the face. The woman became aware her daughter was standing in the doorway. Dediu is said to have told the girl: “Call the police, I’ve assaulted your mum.”

He got hold of the woman’s phone, Mr Tait told jurors, and tried to persuade the girl to unlock it. Angry, he the left the house – allegedly telling the woman ‘look what you’ve made me do. This is your fault because you have made me angry’.

The court heard she had reported the assault to two friends the next day before visiting Chippenham police station.

Dediu, of Westmead Terrace, Chippenham, denies rape and sexual assault by penetration. The trial continues.
